Terms of Use

These Terms of Use ("Terms") govern your use of the Kintra mobile application (the "App"), operated by Ben Orr ("Kintra", "we", "us"). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

You must be at least 13 years old (16 in the EEA/UK) to use Kintra. By using the App you confirm that you meet this requirement and can form a binding agreement.

You are responsible for the accuracy of your account information and for keeping your credentials secure. You are responsible for activity that occurs under your account, and you agree to notify us of any unauthorised use.

Kintra helps you build a consistent training habit by verifying gym attendance and rewarding it with streaks, XP, and ranks, and by connecting you with a community. Streaks, XP, ranks, and any in-app points have no monetary value, cannot be exchanged for cash, and may be adjusted, reset, or discontinued.

Check-ins are verified using your location and a live photo. You agree not to falsify your location, spoof GPS, reuse photos, or otherwise attempt to earn credit for sessions you did not complete. We may flag, reverse, or remove check-ins and XP obtained in breach of these Terms.

You agree not to:

• Harass, bully, threaten, or abuse other users
• Post unlawful, hateful, sexually explicit, or harmful content
• Impersonate others
• Infringe intellectual-property rights
• Interfere with, reverse engineer, disrupt, or gain unauthorised access to the App
• Use the App for any unlawful purpose

You retain ownership of the photos, captions, and other content you post ("User Content"). You grant Kintra a non-exclusive, worldwide, royalty-free licence to host, store, and display your User Content as needed to operate the App (for example, showing your posts in the feed and on your profile). You are responsible for your User Content and confirm you have the rights to share it. We may remove content that breaches these Terms. Users can report content and profiles and can block others.

Kintra Pro is an auto-renewable subscription sold through the Apple App Store.

• Payment is charged to your Apple ID at confirmation of purchase.
• The subscription automatically renews at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours before the end of the current period.
• You can manage or cancel your subscription in your Apple ID account settings after purchase.
• Any unused portion of a free trial (if offered) is forfeited when you purchase a subscription.
• Prices are shown in the App and may vary by region and change over time.

Kintra is not a medical or fitness-advice service. Exercise carries inherent risks. Consult a qualified professional before beginning any exercise programme, and stop if you feel unwell. You take part in physical activity at your own risk. Do not use the App while operating a vehicle or wherever doing so would be unsafe.

The App, including its name, logo, design, and software, is owned by Kintra and protected by law. These Terms do not grant you any right to our trademarks or content except as necessary to use the App.

The App relies on third-party services (including Apple, Supabase, the Google Maps Platform, and RevenueCat). Your use of those services may be subject to their own terms.

You may stop using the App and delete your account at any time. We may suspend or terminate your access if you breach these Terms or to protect the service and its users.

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the App will be uninterrupted or error-free, or that check-in verification will be perfectly accurate.

To the maximum extent permitted by law, Kintra will not be liable for any indirect, incidental, special, or consequential damages, or loss of data, arising from your use of the App. Nothing in these Terms excludes liability that cannot be excluded by law.

You agree to indemnify Kintra against claims arising from your misuse of the App or your breach of these Terms.

These Terms are governed by the laws of England and Wales, and disputes are subject to the courts of England and Wales, unless the law of your country of residence requires otherwise.

We may update these Terms. Continued use of the App after changes take effect constitutes acceptance.

These Terms are between you and Kintra, not Apple, and Apple is not responsible for the App or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. In the event of any failure of the App to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
